Terms of Use of LocalSIM
These Terms of Use, hereinafter referred to as the Terms, govern the use of the LocalSIM website located at https://localsim.io, the LocalSIM mobile application, as well as the procedure for placing orders, payment, delivery and use of access services to eSIM plans.
By using the Website, Mobile Application, placing an order, creating an account or using the Service, the User confirms that they have read and accepted these Terms.
1. Terms and definitions
1.1. “Website Administration” means Localsim LLC, which manages the Website and Mobile Application and organizes the provision of the Service.
1.2. “Website” means the LocalSIM internet resource located at https://localsim.io, including all sections, language versions, order forms, account area and other functions.
1.2.1. “Mobile Application” means the LocalSIM mobile application, including versions for mobile operating systems, interfaces, order forms, account area, notifications and other functions, where such application is available to the User.
1.3. “Service” means access services to eSIM plans and related Website and Mobile Application functions, including order processing, payment, delivery of eSIM installation information, support and account area.
1.4. “User” means any person using the Website, Mobile Application or Service.
1.5. “Customer” means a User who has placed an order on the Website or in the Mobile Application.
1.6. “eSIM” means a digital eSIM profile, QR code, instruction or other data necessary to access the selected eSIM plan.
1.7. “Plan” means the terms of access to mobile internet or other communication services, including country or region of use, data amount, validity period and other parameters specified on the Website or in the Mobile Application.
1.8. “Order” means a request placed by the User on the Website or in the Mobile Application to purchase access to a selected eSIM plan.
2. General provisions
2.1. These Terms apply to all Users and Customers using the Website, Mobile Application and the Service.
2.2. If the User does not agree with these Terms, the User must stop using the Website, Mobile Application and the Service.
2.3. The Website Administration may amend these Terms at any time. The new version becomes effective from the moment it is posted on the Website or in the Mobile Application, unless otherwise stated.
2.4. The User is responsible for reviewing the current version of the Terms.
2.5. The Website Administration may provide certain services, plans, features and offers on additional terms published on the Website, in the Mobile Application or specified during checkout.
3. Description of the Service
3.1. LocalSIM provides Users with access services to eSIM plans for mobile internet or other communication services in countries and regions specified on the Website or in the Mobile Application.
3.2. The Website Administration may act as a platform, intermediary, agent, reseller or other participant in the process of providing access to eSIM plans, cooperating with eSIM providers, telecom operators, payment providers and other partners.
3.3. Specific parameters of an eSIM plan are indicated on the Website or in the Mobile Application and may include:
3.3.1. country or region of use;
3.3.2. validity period;
3.3.3. data amount;
3.3.4. connection type;
3.3.5. availability or unavailability of calls and SMS;
3.3.6. availability or unavailability of tethering;
3.3.7. other restrictions or features.
3.4. The User must carefully review the parameters of the selected plan before placing an order.
4. Registration and account area
4.1. Certain Website or Mobile Application functions may require registration or access to an account area.
4.2. The User is responsible for the accuracy of information provided during registration, order placement and support requests.
4.3. The User is responsible for maintaining security of access to their email, account, devices and other authorization tools.
4.4. All actions performed through the User’s account are deemed to have been performed by the User, unless proven otherwise.
4.5. The Website Administration may temporarily restrict access to an account, order or Service in case of suspected fraud, violation of the Terms, technical error, unauthorized access or other circumstances requiring verification.
5. Placing an order
5.1. The User places an order by selecting a country, region, plan or other offer on the Website.
5.2. Before payment, the User must verify:
5.2.1. country or region of use;
5.2.2. plan validity period;
5.2.3. data amount;
5.2.4. activation terms;
5.2.5. device compatibility with eSIM;
5.2.6. whether the device is network unlocked;
5.2.7. other plan parameters specified on the Website or in the Mobile Application.
5.3. An order is deemed placed after completion of the actions required by the Website or Mobile Application interface.
5.4. The Website Administration may refuse to fulfill or may cancel an order in case of technical error, suspected fraud, inability to fulfill the order, incorrect data, violation of these Terms or other circumstances preventing proper provision of the Service.
6. Payment
6.1. Payment for services is made using payment methods available on the Website or in the Mobile Application through payment partners of the Website Administration.
6.2. Available payment methods, currency, fees, conversion rate and other conditions may depend on the User’s country, payment method, payment provider and other circumstances.
6.3. The Website Administration does not store full bank card details. Payments may be processed by third‑party payment providers.
6.4. The User must use only lawful payment methods and must not perform fraudulent, disputed or unauthorized transactions.
6.5. In the event of a refund, cancellation, disputed transaction or chargeback, the Website Administration may request additional information, restrict access to the Service or suspend fulfillment of the order during verification.
7. Delivery of eSIM
7.1. After successful payment, the User receives information necessary to install the eSIM.
7.2. eSIM installation information may be sent to the email address provided by the User during checkout and may also be available in the account area on the Website or in the Mobile Application if such functionality is provided by the Service.
7.3. The User must ensure that the email address is correct and accessible.
7.4. The Website Administration is not responsible for the inability to receive an email if the User provided an incorrect email address, lost access to the mailbox, the email was sent to spam, blocked by the email service or not received for reasons beyond the control of the Website Administration.
7.5. The User must not transfer QR codes, eSIM profiles, instructions or installation data to third parties where such transfer may lead to unlawful use of the eSIM.
8. Device compatibility
8.1. The User is responsible for checking device compatibility with eSIM before placing an order.
8.2. The User’s device must:
8.2.1. support eSIM;
8.2.2. be unlocked for use with other networks where required;
8.2.3. support the necessary frequencies, technologies and settings for operation in the country or region of use;
8.2.4. have a stable internet connection for eSIM installation where required.
8.3. eSIM compatibility may depend on device model, country of release, operator, software version, settings and other factors.
8.4. Compatibility information published on the Website or in the Mobile Application is for reference only and may be incomplete.
8.5. If the User purchased an eSIM for a device that does not support eSIM or is network locked, the Website Administration may refuse a refund unless otherwise provided by these Terms or applicable law.
9. Installation, activation and use of eSIM
9.1. The User installs the eSIM on their device independently using the provided instructions.
9.2. A stable internet connection may be required to install the eSIM.
9.3. The User is responsible for correct eSIM installation, selecting the line for mobile data, data roaming settings, network selection and other device settings.
9.4. Activation and validity terms may vary depending on the specific plan. The validity period may begin, among other things, from installation, activation, first network connection or another event specified in the plan terms.
9.5. The User must review activation terms before installing and using the eSIM.
9.6. After installation, activation or use of the eSIM, refund, cancellation or replacement options may be limited.
9.7. Deleting the eSIM from the device may make reinstallation impossible. The Website Administration is not responsible for consequences of deleting the eSIM by the User unless otherwise expressly stated on the Website, in the Mobile Application or in the instructions.
10. Network limitations
10.1. The Website Administration does not own all mobile networks and does not always directly control the network infrastructure used to provide communication services.
10.2. Quality, speed, availability, coverage, stability, 3G/4G/5G support, tethering availability, latency and other connection parameters may depend on:
10.2.1. country or region of use;
10.2.2. local telecom operator;
10.2.3. network coverage;
10.2.4. device model and settings;
10.2.5. network congestion;
10.2.6. weather, terrain, buildings and other physical factors;
10.2.7. restrictions of the specific plan;
10.2.8. maintenance or failures of partners and telecom operators.
10.3. The Website Administration makes reasonable efforts to provide quality Service but does not guarantee uninterrupted, error‑free, secure, constant or uniform network operation.
10.4. Certain plans may be data‑only and may not include calls or SMS.
10.5. Tethering, 5G, calls, SMS, top‑ups, extensions or eSIM reinstallation depend on the specific plan terms.
11. User obligations
11.1. The User agrees to:
11.1.1. use the Website and Service in good faith;
11.1.2. provide accurate information;
11.1.3. verify plan parameters before payment;
11.1.4. verify device compatibility before purchase;
11.1.5. not transfer the eSIM profile to third parties where this may violate the Terms;
11.1.6. not use the Service for illegal, fraudulent, harmful, offensive or otherwise unlawful actions;
11.1.7. not interfere with the Website, Mobile Application, networks, equipment, partners or other users;
11.1.8. promptly contact support in case of technical issues;
11.1.9. cooperate with the Website Administration when verifying technical issues, refunds, disputed transactions and fraud cases.
12. Prohibited use
12.1. The User must not use the Website, Mobile Application or Service:
12.1.1. for illegal activity;
12.1.2. for fraud, spam, harmful actions or circumvention of restrictions;
12.1.3. to violate third‑party rights;
12.1.4. to interfere with networks, equipment, software or the Website;
12.1.5. for resale, transfer or commercial use of eSIM without consent of the Website Administration;
12.1.6. to create excessive load on the Website, Mobile Application, network or infrastructure;
12.1.7. using stolen, fake or unauthorized payment methods.
12.2. In case of violation of these Terms, the Website Administration may restrict, suspend or terminate the User’s access to the Service, cancel an order, refuse a refund, block an account or take other reasonable measures.
13. Refunds, cancellation and replacement
13.1. Refund, cancellation or replacement of an eSIM is possible only where technically available and before eSIM activation, unless otherwise provided by applicable law or separate terms published on the Website.
13.2. After installation, activation, network connection, start of plan validity or use of the eSIM, refund may be impossible or limited.
13.3. A refund may be considered if the eSIM cannot be installed or used due to a confirmed technical issue on the side of the Service, eSIM provider or another partner, provided that the User contacted support in a timely manner and cooperated in troubleshooting.
13.4. To review a refund request, the User may be required to provide:
13.4.1. order number;
13.4.2. email used for purchase;
13.4.3. description of the issue;
13.4.4. screenshots of device settings;
13.4.5. device model information;
13.4.6. other information necessary for verification.
13.5. A refund may be refused if:
13.5.1. the eSIM has been activated or used;
13.5.2. the eSIM has been installed and its reuse or cancellation is technically impossible;
13.5.3. the User selected an incorrect country, region or plan;
13.5.4. the User’s device does not support eSIM;
13.5.5. the User’s device is network locked;
13.5.6. the User deleted the eSIM from the device;
13.5.7. the plan validity period has expired;
13.5.8. the data under the plan has been used in whole or in part;
13.5.9. the User did not provide information necessary for verification;
13.5.10. there are signs of fraud, abuse or violation of these Terms.
13.6. No refund is provided for unused data remaining after the plan validity period expires, unless otherwise stated on the Website or in the Mobile Application.
13.7. If a refund is approved, it is processed by the method determined by the Website Administration or payment provider, usually to the original payment method where technically possible.
13.8. The refund crediting time depends on the bank, payment system, payment provider and other circumstances beyond the control of the Website Administration.
13.9. To request a refund, the User may contact info@localsim.io.
14. Support
14.1. The User may contact support regarding orders, payment, installation, activation, refunds or technical issues.
14.2. Requests may be sent to info@localsim.io or through other channels specified on the Website or in the Mobile Application.
14.3. The Website Administration may request additional information necessary to review the request.
14.4. Response time may depend on the nature of the issue, involvement of partners, telecom operators, payment providers and other circumstances.
15. Intellectual property
15.1. All Website and Mobile Application materials, including texts, design, logos, images, interface elements, databases, software code and other objects, belong to the Website Administration or are used lawfully.
15.2. The User may not copy, distribute, modify, reproduce, commercially use or otherwise use Website or Mobile Application materials without consent of the Website Administration, unless permitted by applicable law.
16. Liability and warranties
16.1. The Website, Mobile Application and Service are provided on an “as is” and “as available” basis unless otherwise expressly stated on the Website or in the Mobile Application.
16.2. The Website Administration does not guarantee that the Website, Mobile Application or Service will operate continuously, without errors, delays, failures, restrictions or interruptions.
16.3. The Website Administration is not responsible for:
16.3.1. actions or omissions of telecom operators, eSIM providers, payment providers and other third parties;
16.3.2. lack of coverage or reduced network quality;
16.3.3. incompatibility of the User’s device;
16.3.4. incorrect installation, deletion or configuration of the eSIM by the User;
16.3.5. incorrect email address provided by the User;
16.3.6. inability to receive emails for reasons beyond the control of the Website Administration;
16.3.7. User’s expenses for alternative communication, roaming, local SIM cards, hotel phones, transportation, accommodation or other related expenses;
16.3.8. losses resulting from the User’s violation of these Terms.
16.4. To the extent permitted by applicable law, the liability of the Website Administration is limited to the amount actually paid by the User for the relevant order.
17. Suspension and termination of access
17.1. The Website Administration may temporarily suspend or terminate the User’s access to the Website, Mobile Application, account area or Service in case of:
17.1.1. violation of these Terms;
17.1.2. suspected fraud;
17.1.3. disputed or unauthorized payment;
17.1.4. technical error;
17.1.5. request of a competent authority;
17.1.6. other circumstances requiring protection of the Website, Mobile Application, Users, partners or the Website Administration.
18. Dispute resolution
18.1. All disputes and disagreements related to the use of the Website, Mobile Application, Service, orders, payments, refunds and these Terms shall be resolved by negotiation and written communication where possible.
18.2. The User may send a request to info@localsim.io.
18.3. Disputes shall be resolved in accordance with applicable law.
19. Changes to the Terms
19.1. The Website Administration may amend these Terms at any time.
19.2. The new version of the Terms becomes effective from the moment it is posted on the Website or in the Mobile Application, unless otherwise stated in the new version.
19.3. Continued use of the Website, Mobile Application or Service after publication of the new version means the User’s acceptance of the changes.
